Grant of Administration ad Colligenda Bona
An emergency Grant issued in order to protect certain aspects of an estate
A Grant Ad Colligenda Bona is a form of limited Grant for the purpose of protecting assets. It is limited to a particular purpose and cannot be used to distribute the estate.
To obtain this type of Grant, the Registrar at the Probate Registry will need to make an order under Rule 52(b) of the Non-Contentious Probate Rule 1987.
If there is a delay in the appointment of an administrator or any Will be proved, it may be possible for a local authority or someone on their behalf to apply to be administrator ad colligenda bona, to ensure the protection of an empty property and to preserve the asset for the ultimate beneficiaries of the estate.
If the property is falling into disrepair or the sale of an empty property may be lost or delayed, this will give the local authority the opportunity to secure that asset.
A full Grant will be required to fully distribute the estate and the ad colligenda bona administrator must ensure they don’t stray from what is permitted by the limited Grant, as they may be held personally liable. The limited Grant will in some cases allow a local authority to deal with an empty property and bring it back into use much sooner and without further deterioration.
